Ukraine REACH to Be Enforced by January 2025
On July 23, 2024, the Ukrainian Cabinet of Ministers approved Resolution No. 847, establishing the Technical Regulation on the Safety of Chemical Products, commonly known as Ukraine REACH. This regulation aligns Ukraine’s chemical legislation with European standards to ensure a high level of protection for human health and the environment. The regulation will come into force on January 26, 2025.
Ukraine REACH Registration Scope and Requirements
Ukraine REACH applies to all chemical products produced, imported, or placed on the market within Ukraine. The registration requirement applies to the following scenarios:
- Substances on their own, manufactured/imported ≥ 1 ton/year
- Substances in mixtures, manufactured/imported ≥ 1 ton/year
- Substances intended to be released in an article (≥ 0.1% concentration), manufactured/imported ≥ 1 ton/year
Certain products, such as medicinal products, food products, veterinary medicines, and low-risk chemicals are exempt from this regulation.
Registration Deadlines and Transition Period
The pre-registration deadline for chemical substances that already exist in the market before the regulation takes effect is set for January 26, 2026. After this transitional period, the registration deadlines are as follows:
- 1000 t/year or more: October 1, 2026
- Carcinogenic, mutagenic, or toxic for reproduction substances: October 1, 2026
- Substances with chronic aquatic hazard: October 1, 2026
- 100 ~ 1000 t/year: June 1, 2028
- 1 ~ 100 t/year: March 1, 2030
Simplified Registration Process
For chemical substances already registered under EU REACH, a simplified registration process will be available with fewer dossier requirements, making compliance easier.
Authorisation and Highly Dangerous Chemicals
Ukraine REACH maintains a List of Authorisation for 59 highly dangerous chemicals, with application dates set for April 1, 2027 and sunset dates by June 1, 2027. Manufacturers and importers wishing to continue placing such substances on the market after these dates will need to apply for authorisation for specific uses.
Ukraine’s adoption of the REACH regulation from January 2025 is a significant step toward enhancing chemical safety. Manufacturers and importers must ensure compliance with the new regulation to continue operating within Ukraine’s market.
