Product Safety Legislation in Türkiye

Under the Customs Union between Türkiye and the European Union, Türkiye aligns its national product legislation with EU technical legislation. In this framework, Law No. 7223 on Product Safety and Technical Regulations was published in the Official Gazette on 12 March 2020 and entered into force on 12 March 2021, repealing the former Law No. 4703.

The Law sets out the procedures and principles for:

placing products on the market,
conformity assessment,
market surveillance and inspection,
notifications related to these processes.

All products, whether manufactured in Türkiye or imported, must meet minimum safety requirements in terms of human health, safety of life and property, animal and plant life and health, and the protection of the environment and consumers.

Market Surveillance Framework Regulation

The Framework Regulation on Market Surveillance and Inspection of Products, adopted by Presidential Decision No. 4269 and published in Official Gazette No. 31537 of 10 July 2021, sets out the obligations of economic operators: manufacturers, authorised representatives, importers and distributors.

Under Article 13 of the Regulation, the Ministry of Trade publishes on its website information on product requirements, the rights and obligations of economic operators and an up-to-date list of the technical regulations in force.

Key Provisions of Law No. 7223

Exports: Products exported to EU Member States are deemed to be placed on the market under the Law. Products exported to other countries must also be safe, must not be adulterated and must be labelled and documented so as not to mislead the buyer (Article 2).
E-commerce: If a non-compliant product is promoted or sold online and the content is not removed within 24 hours of notification, the competent authority may block access to that content (Article 17).
Traceability: Economic operators must record the operators that supplied them and those they supplied, and keep these records for at least ten years (Article 12).
Recalls: Where other measures are not sufficient, unsafe products must be recalled, and end users are offered repair, a refund of the retail value or replacement with a safe product (Article 19).
Liability: If a product causes damage to a person or property, the manufacturer or importer is obliged to compensate for the damage (Article 6).

Administrative Fines

Under Article 20 of Law No. 7223, those who breach the product safety provisions of technical regulations or general product safety legislation face an administrative fine originally set at TRY 50,000 – 500,000.

The amounts are revalued every year. For 2026, the range is TRY 434,505 – 4,345,058 (Product Safety and Inspection Communiqué No. 2026/13).

The Blue Guide

The Blue Guide on the implementation of EU product rules is the main reference document for EU harmonisation legislation. It explains CE marking, the obligations of economic operators, conformity assessment modules, technical documentation and market surveillance.
