Ukraine CLP Technical Regulation: New Provisions and Implementation Dates
Ukraine has taken a significant step in regulating the classification, labeling, and packaging of chemical products. The Technical Regulation (TR), prepared by the Ministry of Environmental Protection and Natural Resources, was approved by the Ukrainian Government on May 10, 2024. This regulation establishes the basic rules for hazard classification and labeling of chemical products, filling a gap that existed in the country.
Importance of the Regulation
The new Technical Regulation harmonizes Ukrainian legislation with European Union and international standards. It aligns with the EU’s CLP Regulation (Regulation No. 1272/2008) and the UN’s GHS system, enhancing the safety of chemical products and raising the standards for international trade.
Scope of the Regulation
This regulation applies to chemical products marketed or produced in Ukraine. Chemical products cannot enter the Ukrainian market unless they meet the requirements of this TR. Manufacturers, importers, and other suppliers must gather reliable information on the hazardous properties of chemicals, evaluate its validity, and apply the hazard classification criteria specified in the regulation.
Exempt Products
Certain products are exempt from this regulation. These include radioactive materials, products under customs control, chemicals intended for controlled scientific use, and waste. Additionally, finished chemical products intended for end consumers, such as medical devices or cosmetics, are also excluded from this regulation.
