Request for Comments on the Draft Regulation Amending the Regulation on Cosmetic Products
The Turkish Medicines and Medical Devices Agency (TİTCK) has taken a significant step toward a comprehensive revision in the cosmetics sector. These changes aim to address certain challenges faced by the industry and ensure alignment with the European Union Cosmetic Regulation (EC) No 1223/2009. The new regulations bring innovations in several areas, particularly concerning digital labeling and compliance with the REACH Regulation.
Key Highlights of the Draft Amendment
- Digital Labeling and QR Code Usage
The new regulations allow for the use of digital labels and QR codes on small packaging. This enables access to product information through both traditional methods and digital platforms. Digital labels provide an efficient way to offer more detailed information while maximizing the use of limited packaging space.
2. Restrictions on Environmentally Harmful Substances (D5 and D6)
Starting from December 1, 2026, the use of Decamethylcyclopentasiloxane (D5) and Dodecamethylcyclohexasiloxane (D6) in rinse-off cosmetic products will be limited to a maximum concentration of 0.1%. This restriction will apply to all cosmetic products as of June 6, 2027. Aligned with the EU REACH Regulation, this measure aims to reduce environmental impacts. From December 1, 2026, D5 and D6 components cannot exceed 0.1% in rinse-off cosmetics, and from June 6, 2027, this restriction will extend to all cosmetic products. This provisional measure will be repealed in alignment with the KKDIK Regulation, published in the Official Gazette on June 23, 2017 (30105 duplicate issue), which harmonizes with Regulation (EC) No 1907/2006 (REACH).
3. Paid Notification Process for Cosmetic Products
The draft regulation introduces a fee for cosmetic product notifications. Companies will be required to pay a fee to the TİTCK for submitting product notifications via the National Electronic Database.
4. Updates to the Regulation Annexes
Annexes II, III, V, and VI, which contain lists of banned substances, restrictions, and allowed preservatives, have been updated. These updates aim to protect consumer health and ensure product safety.
