The European Commission has adopted the revised REACH Fee Regulation, introducing a significant procedural change for micro, small, and medium-sized enterprises (SMEs).
From 5 February 2027, SMEs will be required to apply for company size validation before submitting any REACH registration or authorisation dossiers in order to benefit from reduced fees.

Meanwhile, standard fees for large enterprises will increase by 19.5%, reflecting inflation adjustments and aligning with the average annual inflation rate in Europe for 2021–2023.

Key Change: Ex-Ante SME Verification

Under the new system, companies that wish to claim SME fee reductions must undergo an ex-ante verification of their size status.
This means the validation process must be initiated at least two months before dossier submission to ECHA.

Once the application and supporting documents are received, ECHA will have two months to verify the company’s SME status.
To avoid delays and maintain eligibility for reduced fees, SMEs are strongly encouraged to apply as early as possible, allowing sufficient time to respond to any requests for additional information.

Administrative Implications and Validity Period

If ECHA determines that a company does not qualify as an SME, it may impose an administrative charge, the amount of which will be set by ECHA’s Management Board.

For companies successfully validated as SMEs, the recognised status will remain valid for three years from the date of ECHA’s decision.
If a company’s size remains unchanged, the first renewal of this status can be done through self-declaration, provided it is submitted two months before the three-year validity expires.

This streamlined renewal mechanism aims to reduce administrative burden while maintaining accuracy and transparency in SME classification.

To safeguard the competitiveness of smaller actors, the 19.5% fee increase applies exclusively to large enterprises.

The European Commission adopted the revised REACH Fee Regulation on 15 October 2025.
The Regulation will enter into force 20 days after publication in the Official Journal of the European Union.
The new ex-ante verification mechanism will become applicable 15 months later, starting 5 February 2027.

Until that date, the current post-submission SME verification procedure will continue to apply.
